General Conditions of Sale
PREAMBLE
The company HALO CONCEPT SAS is active in the creation, production and commercial operation of a merchant website, including sales and back-office activities, in its name on behalf of its customers, as well as associated activities such as the promotion of this website and the promotion of the products sold.
HALO CONCEPT SAS is responsible for the creation and management of the website www.haloconcept.com (hereinafter “the Site”);
These General Conditions of Sale are intended to define the rules applicable within the framework of the sale of products (hereinafter “the Product(s)”) on the Site,

The company HALO CONCEPT SAS. (hereinafter “HALO CONCEPT SAS.”),
whose head office is located at 732 chemin des colles, 06740 Chateauneuf, France

Any adult natural person, non-trading, with the legal capacity to contract, domiciled exclusively in the countries delivered by www.haloconcept.com (hereinafter “the Customer”) making a purchase of a Product
on the Site.
For the purposes of this document, it is agreed that the Client and HALO CONCEPT SAS will be collectively referred to as
the “Parties” and individually referred to as the “Party”.
These general conditions (hereinafter the “General Conditions of Sale”) govern without restriction the sales of Products by HALO CONCEPT SAS. from the Site.
HALO CONCEPT SAS. reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on the Site. The applicable General Terms and Conditions of Sale are those in force on the site on the date the order is placed by the Customer; it being specified that any order for a Product offered on the Site implies the Customer's full and complete acceptance of the General Terms and Conditions of Sale in force at the time the order is placed.
ARTICLE 1. PURPOSE
The purpose of these General Terms and Conditions of Sale is to define the conditions under which the Products are marketed by HALO CONCEPT SAS. to the Customer. They thus regulate the different stages of completion of the sale: from the placing of the order by the Customer to the delivery of the Product to the Customer.
ARTICLE 2. PRODUCTS
The Products offered for sale by HALO CONCEPT SAS. are those appearing on the site on the day of its consultation by the Customer; it being specified that the photographs illustrating the Products are not contractual. Each Product will be the subject of a descriptive sheet which, in addition to the photograph, will contain: the price, sizes, composition, as well as the particular characteristics.
HALO CONCEPT SAS undertakes to deliver Products that meet the requirements in force relating to the safety and health of people in accordance with European provisions, and in particular the legislation on regulated chemical substances.
ARTICLE 3. PRICE
Prices are indicated in euros, all taxes included, excluding delivery costs; it being specified that the value added tax is that in force on French territory on the day the order is validated.
The prices applied are those communicated on the Site and confirmed to the Customer when the order is validated.
Delivery costs are communicated to the Customer on the order summary before validation of the latter and are expressed inclusive of all taxes. These costs are the responsibility of the Customer and are invoiced in addition
of the sale price of the Products.
The transfer of risks of loss and deterioration of the Products will be carried out after delivery and receipt of the Products by the Customer.
ARTICLE 4. ORDERING AND PAYMENT OF PRODUCTS
4.1 Placing an order
The Customer completes his order by completing the following 5 steps:
Step 1: The Customer selects the chosen Products and adds them to their basket after having selected (optionally) the desired color.
The basket located at the top right of the screen informs the Customer that it has taken the selections into account by indicating the number of Products it contains.
Step 2: The Customer checks the contents of their basket by clicking on "order" in order to access the summary of their order. The Customer can then modify their order (Product, color, quantity).
The total amount including tax of the order, distinguishing on the one hand the price due for the Products, and on the other hand the delivery costs, is then indicated in the summary.
Step 3: Once the order has been checked and modified if necessary, the Customer validates their basket in order to finalize their order by clicking on “order” again.
If the Customer has an advantage code, reserved for the best Customers, he must enter it in the space provided for this purpose in order to benefit from it.
Step 4: Customer enters delivery and billing details
Fields marked with an asterisk (*) are mandatory fields; it is specified that unless otherwise indicated by the Customer, the billing address will automatically be the same as the delivery address.
If the Customer has already placed an order on the Site, he has a customer account. In such a case, he will identify himself only with his email address and password.
The Customer then checks all the information and clicks on “validate” to continue with their order.
Step 5: Enter your bank details
The Customer will then access the secure payment screen of HALO CONCEPT SAS's partner, as specified in the article
4.3 below.
Payment is made online by credit card or PayPal account.
The Customer must connect to their PayPal account or enter their bank card number, its expiry date and the 3 numbers of the visual cryptogram on the back of their card, it being specified that in the event of payment by
American Express card, the Customer must provide 4 digits.
If payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.
In the event of payment failure, the Customer will have up to 3 attempts to re-enter their bank details. After the 3rd refusal, the Customer will be redirected to the Site to a screen indicating the refusal of payment. The Customer will then be invited to contact HALO CONCEPT SAS customer service to find out the reasons and find a solution together to finalize the Customer's order.
4.2 - Confirmation of the order
Upon acceptance of the Customer's payment, the Customer will receive an email confirming their order, summarizing all the items ordered, the billing and delivery address and the estimated delivery date.
The validation of the order by the Customer and the order confirmation sent to the Customer by email by HALO CONCEPT SAS. following acceptance of payment constitute the conclusion of a sales contract between the Parties and acceptance of the General Conditions of Sale.
The Customer having placed an order will have the possibility of printing his invoice by connecting to the Site in the order tracking area provided for this purpose.
HALO CONCEPT SAS reserves the right not to validate the order in the event of:
• abnormal or abusive complaints,
• abnormal orders with regard to the quantities ordered,
• abnormal or abusive exchanges and returns,
• existing dispute(s) with the customer.
The site's customer service is available to the Customer for any questions relating to their order.

4.3 - Payment
The price of the Products purchased is payable in cash, in full on the day the order is placed by the Customer.
Payment is made online by PayPal or by bank card (Carte Bleue, Visa, Eurocard/Mastercard) at the time the order is validated by the Customer.
The request for authorization to debit the card is made at the time of validation of the order on the Site, except in the event of unavailability of the servers. HALO CONCEPT SAS. reserves the right to proceed with a new
direct debit authorization request in the event that the first could not be completed due to server unavailability.
In the event of non-payment, an incorrect address or any other problem with the Customer's account, HALO CONCEPT SAS reserves the right to block the Customer's order until the problem is resolved.
HALO CONCEPT SAS. disclaims all liability in the event of fraudulent use of a Customer's bank card on the Site. This data cannot be detected, intercepted or used by third parties. At no time does the Customer's financial data pass through the HALO CONCEPT SAS computer system.
4.4 – Archiving the order
The order confirmation is recorded in the records of HALO CONCEPT SAS., which are themselves stored on a reliable and durable medium. The Customer accepts that the order confirmation is considered as proof of the contractual relations between the Parties.
ARTICLE 5. DELIVERY
HALO CONCEPT SAS. will make its best efforts to ensure that the order accompanied by a delivery note (subject to perfect payment and collection of the order) is delivered within an average of three (3 to 5) working days in mainland France (including Corsica) and Monaco. The countries of the European Union will be delivered within an average of four (4) to seven (7) working days.
Any product purchased on the site will be delivered within a maximum of thirty (30) working days from the day following payment of the order to the address indicated by the Customer when ordering on the Site.
In the event of the delivery time being exceeded, not justified by a case of force majeure, the Customer may request the cancellation of the sale and obtain within a maximum period of 30 (thirty) days the reimbursement of the sums paid to
the occasion of the sale.
For orders outside France, when the package intended for export reaches its destination, it will be the recipient's responsibility to pay the taxes or customs duties that apply to the destination country. The local authorities can provide you with useful information.
ARTICLE 6: RECEIPT OF THE ORDER – COMPLAINTS –
RETURNS
The Customer is required to check the conformity of the Products received in execution of his order at the time of delivery.
Any anomaly concerning the delivery such as:
• damaged package,
• Missing products,
• Damaged products,
• Products not conforming to the order,
must be notified within fifteen (15) days following receipt of the order.
This notification will be sent to the site's customer service either:
- By registered mail, writing to the following address: HALO CONCEPT SAS
- By email to contact@haloconcept.com
After this period, and except for hidden defects, no claims will be accepted by HALO CONCEPT SAS, the Products then being deemed compliant.
For any return of a non-compliant Product, the Customer must follow the following procedure:
• the Customer must enclose with his package the return slip issued by HALO CONCEPT SAS.
• the Products must be returned in their original packaging, with their label and any accessories, in impeccable condition to HALO CONCEPT SAS
- The risks and costs of return are the exclusive responsibility of the Customer.
When non-compliance has been noted, HALO CONCEPT SAS will offer the Client either:
• the replacement of the Product(s) at the expense of HALO CONCEPT SAS., or
• reimbursement of the price of the order (price of the Products and delivery costs) as well as the costs of returning the non-compliant Product, at the latest within thirty (30) days from the date of sending the notification of confirmation of non-compliance by the site's customer service.
In the event of a refund, HALO CONCEPT will reimburse all products returned to conformity, as well as shipping costs incurred, with the exception of taxes and customs duties paid by the customer upon delivery.
Cash on delivery returns are not accepted. Upon receipt of a non-compliant item, HALO CONCEPT will reimburse the postal return costs up to the price list (Colissimo delivery without registered mail) displayed by La Poste on March 1 of the current year. The Customer must send proof of the return costs incurred to Customer Service, by email or by post.
In the event of abnormal or abusive complaints, HALO CONCEPT SAS may refuse to serve a subsequent order.
ARTICLE 7. RIGHT OF WITHDRAWAL
The Customer has a period of fifteen (15) working days from the date of receipt of his order to return the Products ordered, without justification or penalty.
For any return under the right of withdrawal, the procedure below must be fully followed:
• the Customer must enclose with his package the voucher issued by HALO CONCEPT SAS.
• the Products must be returned in their original packaging, with their label and any accessories, in impeccable condition to HALO CONCEPT SAS.
• The risks and costs of return are the exclusive responsibility of the Customer.
Subject to the conditions recalled above, HALO CONCEPT SAS. will reimburse the amount including tax of the order to the Customer (price of the Product and delivery costs) excluding return costs. The Customer's bank account will be credited with said amount, within thirty (30) days from receipt of the Products by HALO CONCEPT SAS.
ARTICLE 8 – PERSONAL DATA
HALO CONCEPT SAS collects a certain amount of information necessary for processing orders.
This data is not only necessary for the processing of the Customer's order by HALO CONCEPT SAS, but also to communicate information to the Customer on the site or to allow them to benefit from it.

Following any injunction from legal authorities or in order to defend its rights or those of its employees, customers or any other person, HALO CONCEPT SAS may communicate this data to legally required organizations and authorities.

HALO CONCEPT SAS. undertakes to take all useful precautions to ensure the security of its files and the protection of its computer system, and in particular to prevent the Client's personal information from being
distorted, damaged or accessed by unauthorized third parties.
The Client's personal information is sent and stored at the site's host located in France, whose contact details appear on the site under the "Legal Notices" section.
ARTICLE 9. COOKIES
In order to process the Customer's order, and in order to better understand their needs and personalize the services offered on the Site, HALO CONCEPT SAS. uses cookies. A cookie is a computer file, stored on the
hard drive of the Client's microcomputer which is intended to signal his visit to the Site.
Cookies store the Customer's visit time on the Site, their identifiers and the contents of their shopping cart. Once disconnected from the Site, this information is stored for 30 (thirty) days before being permanently deleted.
The Customer may oppose the recording of cookies by configuring his Internet browser. He then loses all personalization of the service offered to him on the Site.
ARTICLE 10. LIMITATION OF LIABILITY
Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet network, in particular with regard to technical performance, response times, connection times, queries or transfers of information, risks of disconnection, risks of contamination by viruses circulating on the network and, in general, all risks linked to the use of the Internet network.
HALO CONCEPT SAS. cannot therefore be held responsible in any way for any direct or indirect damage resulting from improper use or incident linked to the use of the computer, Internet access, maintenance or
malfunction of the servers, the telephone line or any other technical connection, the Client's connection to the Site being made under his/her entire responsibility.
ARTICLE 11. FORCE MAJEURE
HALO CONCEPT SAS will not be liable for the total or partial non-performance of its obligations under the order placed by the Customer, if this non-performance is caused by an event constituting a case of force majeure as defined by positive law.
In such a case, HALO CONCEPT SAS will inform the Client of the occurrence of such an event within 3 (three) clear days following its occurrence, by email.
After a period of 1 (one) month, and in the event that the event constituting a case of force majeure persists, the order will be cancelled and, where applicable, will be subject to a refund from HALO CONCEPT SAS. on the card
bank details used to place the order within a maximum period of 30 (thirty) days.
ARTICLE 12. APPLICABLE LAW
If any of the terms of these General Conditions of Sale are found to be null and void, illegal or unenforceable by a court decision, the other provisions of the General Conditions of Sale shall remain in force.
The General Conditions of Sale are executed and interpreted in accordance with French law.
In the event of a dispute, the customer will first contact HALO CONCEPT SAS to obtain an amicable solution and, failing agreement, the Courts of Grasse, France will have sole jurisdiction.
